OIC: Why do I Need to go Through the Portal?

After being involved in a non-fault accident, you may be directed to the Official Injury Claim (OIC) portal to begin your claim for personal injury compensation.

A relatively new creation, it is not something that many people are aware of or know how to navigate.

Here, we aim to answer some of the key questions around it and put you more at ease with approaching it.

What is the OIC?

The Official Injury Claim portal was first launched on 31st May 2021, after years in the making in co-ordination with the insurance industry and the Ministry of Justice.

The intention of the OIC is to decrease the number of whiplash claims made each year, with insurers stating they will pass on the savings from this to their customers in the wake of legal reforms known as the ‘Whiplash Reforms’.

 You can access the portal, without legal help if you wish to, although help is also available, for claims under £5,000 in value. However, for anything more than this, you will need to consult with a legal professional who will be able to guide you through the process of making a claim.

What about dealing with my injury?

When it comes to getting treatment and compensation for an injury that wasn’t your fault, you still, as part of the new process, need to get a medical report from an independent medical professional. This will then be used as the basis for any negotiations with an insurer with regards to an agreed compensation figure.

When entering the process of obtaining a medical report through the portal, you will receive the choice of which medico-legal provider to go with, or you can go direct to the medical expert. The latter option, however, means you need to make your own arrangements at a time when you’d probably want someone else with experience to handle it all.
